To further emphasise the significance of responsible and regulated surrogacy practices in India, the legislation lays forth numerous requirements that must be completed before a couple or individual can opt for surrogacy in the country.

Surrogacy, a form of assisted reproductive technology, When a woman agrees to carry a child for another couple or individual, they are engaging in surrogacy, a kind of assisted reproduction. Altruistic surrogacy is a process where a woman carries a baby for another couple or individual without any financial compensation. It’s a noble deed that gives hope to childless couples who can’t have children any other way. The low surrogacy cost has made surrogacy an option for couples all around the world, particularly in India.

Eligibility Criteria for surrogacy to Intended Parents

A new surrogacy law in India would require prospective parents to meet certain requirements by 2021 in order to pursue the option. The Act specifies that in order to seek surrogacy services,

Marital Status: The couple must have been married for at least five years to seek a surrogacy.

Age Limit: The male partner must be between the ages of 26 and 50 and The female partner must be between the ages of 23 and 50.

Medical Requirement: They also need to provide a medical infertility certificate by professional’s infertility  to center to prove that they can’t have children.

 

Nationality: The Only Indian citizens are eligible for Surrogacy by Surrogacy (Regulation) Act, 2021,

Eligibility Criteria for Single Women

The women between the ages of 35 and 45 who are single, married, divorced, or widowed are also considered for surrogacy. However, if a woman already has a child from a previous relationship who is still alive, she is not eligible for surrogacy.

Requirements for Becoming a Surrogate Mother?

Becoming a surrogate mother is an important decision that should not be taken lightly as there are extensive standards and the surrogate must meet the following criteria:

 

Altruistic Intent: The surrogate must have the intention to bear a child for another spouse without any financial gain for herself as commercial surrogacy is illegal.

 

Age and Marital Status: The surrogate must also fall within certain age between 25 to 35 

 

Parental Experience: She must already be the mother of at least one child. Because they prove the surrogate has the maternal experience and mental strength to carry a pregnancy to term, these requirements are mandatory.

 

Health Requirements: The surrogate must provide certificates of physical and mental fitness to demonstrate that she is healthy enough to carry out the surrogacy process safely for herself and the unborn child.

 

Surrogacy attempt: Each surrogate is only allowed one attempt, and intended parents are only allowed three attempts, all in the name of safety. To further ensure the safety of both the embryo and the mother, only one transfer is performed at a time.

Surrogacy Approval Process in India

The Indian Surrogacy Act of 2021 lays forth a rigorous approval process to guarantee moral surrogacy procedures. An application, containing the surrogate mother’s medical and family history, and a medical fitness certificate, must be submitted to the National Surrogacy Board for approval. Surrogacy centres are essential in enabling the surrogacy agreement, coordinating medical procedures, and guaranteeing the wellbeing of all parties once the application has been accepted by the appropriate authorities and the intended parents can begin working with a centre.
